These Terms and Conditions (“Terms”) constitute a legally binding agreement between Proensafe MS Pvt Ltd (“Company”, “We”, “Us”, or “Our”) and the user or customer (“User”, “You”, or “Your”).   • You are a resident of India.

  • If you are representing an entity or organization, you confirm that you have the necessary power and authority to bind such an entity to these Terms.

2. Acceptance of Terms

By accessing our Platform or utilizing our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, available at https://www.proensafemspvtltd.com/privacy-policy. If you do not agree to these Terms, you must immediately cease use of the Platform and Services.

3. Scope of Services

Proensafe MS Pvt Ltd specializes in Construction, Interior Design, and Renovation services.

  • Project Management: The Company acts as the primary project lead, coordinating services through architects, contractors, and third-party partners.

  • Service Partners: Specialized project partners selected by Proensafe MS Pvt Ltd may be responsible for the direct supply of construction materials and specialized design services.

  • Marketing Consent: Proensafe MS Pvt Ltd reserves the right to publish photographs or digital representations of completed projects on our official website and social media channels for promotional purposes.

4. Permits, Licenses, and Approvals

  • Client Responsibility: The Project is subject to approval by relevant governmental and local authorities. It is the sole responsibility of the Customer to obtain all necessary permits, licenses, and NOCs (No Objection Certificates).

  • Assistance: Proensafe MS Pvt Ltd may, at its discretion, assist the Customer in the application process for these approvals, but does not guarantee the issuance of such permits by the government.

5. Financial Terms and Taxation

  • Quotations: Detailed price quotations will be issued for all requested services.

  • Taxes: All prices are subject to GST and other government levies as per prevailing policies.

  • GST Clause: Unless otherwise stated, a 4.5% GST rate is applicable on the specific prices mentioned in our pricing sections (marked with *).

6. Customer Responsibilities

  • Accuracy of Information: The Customer must provide accurate, complete, and timely data as required for the correct execution of the project.

  • Site Access: The Customer shall ensure unhindered access to the project site for the Company’s employees and contractors.

  • Execution: While the Company is accountable for the layout and execution of the work based on agreed designs, the Company is not liable for errors resulting from inaccurate information provided by the Customer.

7. Communication and Data Privacy

  • Call Recording: For quality assurance and training purposes, the Company may record all telephonic conversations between the Customer and our call center or representatives.

  • Data Collection: Proensafe MS Pvt Ltd collects user data, including name, contact information, and project-specific details, to facilitate the delivery of our services in accordance with our Privacy Policy.

8. Termination of Services

  • Right to Terminate: Proensafe MS Pvt Ltd reserves the right to terminate or cancel a service booking at any time, without assigning any reason, subject to the refund policies specified in the underlying operating agreement.

9. Legal Framework

These Terms are independent of any specific operating agreement but work in conjunction with them. In the event of a conflict between these Terms and a specific project contract, the terms of the project contract shall prevail regarding the technical execution of the work.
